General Terms & Conditions

Introduction

Please read carefully the following General Terms and Conditions (hereinafter the “Terms”) before you as User (hereinafter you or “User”) start using the Services or products developed specifically for this purpose and accessible via the Internet on the www.mypokersite.com Website (hereinafter the “Website”) operated from the Republic of Costa Rica under the My Poker Site brand name.

The Privacy Policy, which is accessible through the Website, and any rules and regulations that may be published on the Website from time to time, constitute an inseparable part of these Terms.

(seat: 95 Wilton Road, Suite 3, London, SW1V 1BZ, United Kingdom) (hereinafter the “Company”) specializes into organizing sports betting, horse racing betting, multiplayer poker, casino and other betting games (collectively also as the “Service”), which can be used by paying with legal tender or money substitutes exchangeable into legal tender (e.g. chips or credit) (legal tender and money substitutes hereinafter collectively as “Real Money”).

The provisions of these Terms apply to bets and games where Real Money is used.

Liability

The Company makes no warranty that access to the Service will be uninterrupted, timely or error-free, that defects will be corrected or that the programs in the Service will be free from viruses or bugs..

The Company reserves the right to suspend, discontinue, modify, remove or add to the Service with immediate effect and without an obligation to provide prior notice or compensation.

Furthermore, the Company reserves the right to open, maintain or close the User’s Betting Account at any time. The decision of the Company as regards the User’s Betting Account is final and shall not be open to review or appeal.
The Company and its representatives shall not be liable for damages arising from the non-usability, defects of operation, delays or misuse of the web portal accessible through the Website unless such damages were caused by the willful conduct or gross negligence of the Company. Furthermore, the Company’s liability shall be limited to the bet amount or prize payable, in such a manner that out of these the highest amount shall be considered.
The Company shall not be liable for direct or indirect damages arising out of the potential misuse of the Betting Account.
The Company reserves the right to exclude the User from the games and bets organized by the Company at any time without reasoning.
The Company states that gambling and participation in sports betting, horse racing, multiplayer poker, casino and other gambling activities is prohibited in some jurisdictions regardless of the betting operating, betting intermediary or betting organizer licenses that the Company may have in the given jurisdiction. Therefore the User acknowledges that he/she shall bear sole responsibility for legal consequences arising from any violation of regulations restricting or prohibiting gambling and the Company is not liable for any damage or loss in this respect.
By making a wager, participating in a game and placing a bet the User represents that he/she is of the age required by the laws applicable in his/her jurisdiction for participation and that he/she is legally able to conclude the transaction. If the Company notices any violation of the above requirements the Company shall immediately terminate the User’s Betting Account and take all necessary steps.

The Service may not be used by individuals under 18 years of age or if the laws of a jurisdiction set the legal age of majority at an older age then by individuals below that age. Furthermore the Service may not be used in jurisdictions where such use is deemed to be illegal.

Ensuring compliance with the above is the sole obligation and responsibility of User.

The Company has the right to check compliance with the above at any time and require that the User provide data and information for this purpose. The Company has the right to suspend or cancel the User’s Betting Account and to temporarily or permanently exclude User from using the Service if User fails to provide or provides only partly the required data or if it is probable that the above conditions were violated.
User agrees that if he/she participates in sports betting, multiplayer poker, horse racing, casino and gambling as well as other games the Company may store and handle the User’s data provided to the Company in accordance with the provisions of the Privacy Policy.
The Company has the right to correct faults in the balance of the Betting Account of which the Company shall inform User.
Upon notice of any suspected fraud or misuse the Company has the right to disclose all data handled by the Company to the relevant authorities.
Texts, images, sound clips and videos available on the Internet sites of the Company or accessible through these sites are only for the personal use of the User and may not be copied, distributed or forwarded.

Registration

Prior to participating in the games and bets organized by the Company the Users are required to register with the Company. For registration the User shall provide on the application form his/her first name and surname, the place of residence, e-mail address, the chosen User ID and password. In case of games played with Real Money the User shall also provide, in addition to the above data, his/her address, phone number and date of birth.
The Company has the right to exclude User from the games and bets organised by the Company if the Company notices that User provided false data for the registration. To confirm such data the User shall, upon request from the Company, provide a copy of his/her photographic ID.
Upon registration the Company opens a cost-free account for the User (hereinafter the “Betting Account”) to credit in Real Money or pay in legal tender the bets and winnings of the User when using the Service.

Betting Account

A User may only have one Betting Account. It is prohibited for the same User to register as a new User by providing a different name or e-mail and open a new Betting Account. In case of violation of the above rule the Company reserves the right to cancel wagers made and bonuses credited.
Only User shall have authority over the Betting Account and he/she may not authorize any other person to dispose of the Betting Account.
Upon notice of any fraud or misuse in the course of betting or playing or in case of breach of these Terms, in particular by multiply registration or opening more than one Betting Account, the Company has the right to exclude User from further use of the Service. In case of exclusion the Company shall deduct 10% handling fee from the Real Money amounts potentially credited to the User’s Betting Account and pay the remaining balance in legal tender to User, provided User obtained it lawfully. The Company is not obliged to pay Real Money credits, whether in legal tender or money substitutes (credit or chips), or winnings obtained thereby if they were obtained unlawfully by User.
User will also loose the bonuses and credits that he/she received after the decision on his/her exclusion had been made but before the conclusion of the exclusion administration procedure.
User has the right to freeze his/her account and by doing so exclude himself/herself from all bets and games. The period of self-freezing the Betting Account shall be determined by User and he/she may use the Service again upon expiry of such period. Self-freezing may not be cancelled during this period and if self-freezing is for an indefinite period of time the Company may only terminate the freeze upon request from and consultation with the User and no sooner than after 6 months from the time of request and consultation. During the period of self-freeze the User may not participate in the promotions of the Company and after the expiry of self-freeze for an indefinite period of time the Company shall have the right to limit User’s participation in promotions.
User acknowledges that monies credited to the Betting Account may not be inherited thus in case of User’s death such monies shall become the property of the Company without any reimbursement obligation to heirs.
User acknowledges that if he/she does not use the Real Money balance on the Betting Account for more than two years, i.e. he/she does not use it for participating in games, does not request pay out or does not credit new monies to the Betting Account, then such amounts shall become the property of the Company and User or his/her legal successors may not enforce any claims for these amounts on any ground.

Account Keeping

For logging in to certain systems of the Service a User ID and password is required but no encryption code is necessary for verifying wagers and bets. Login to individual systems is through the same User ID and password.
If User changes the password all login to the support system of the Service shall take place through the new password.
If User notices that he/she lost his/her User ID and password or lost possession of them in any other manner or they may have been disclosed to unauthorized persons or unauthorized transactions occurred on the account statement, User shall request the Company within 24 hours to prohibit access to the Service by providing his/her User ID.

User shall send the prohibition request to the Company by e-mail to support@mypokersite.com or by fax to +44 (845) 020 4259.

The Company shall not be liable for damages that may arise in connection with the prohibition even if the request is not from the User.

User shall be solely responsible for damages occurring prior to receipt of the prohibition request by the Company including damages arising from delayed notification by User. After receipt of the prohibition request the Company shall be liable for damages up to USD 1,000 (one thousand US dollars). The Company shall not be held liable if the damage or loss was caused by the willful conduct or gross negligence of User.

After three login attempts with incorrect User ID or password the system will automatically lock out the User.

Such prohibition of User’s access applies automatically to the entire Service regardless of which game or bet of the Service was used when the lockout took place.

Cancellation of the lockout may be requested by User through the software used for the Service or by writing to customer support.

Upon cancellation of the lockout the entire Service may be accessed again by User regardless of the game or bet in connection with the User requested the cancellation.

Currencies

Wagers and bets may only be placed in EUR or USD. The Company reserves the right to introduce new currencies or terminate existing ones. In the latter case the balance of the Betting Account shall be paid to User in legal tender if the provisions of these Terms are otherwise complied with.
The Company calculates and records bets and results and the exchange rate used for changing money into money substitutes (chips or credit) to the fourth decimal place and uses this value as a base for all future calculations. The Company specifies the balance of the User’s Betting Account to the second decimal place and this rounding up may result in differences between the two values above. In such cases the actual value prevails over the figure rounded up to the second decimal place and displayed on the Betting Account. In the course of purchasing money substitutes (chips or credit) or conducting other transactions the Company shall apply the exchange rate published daily by Reuters as the reference exchange rate for changing one currency into another on the Betting Account.

Betting with Real Money

The User shall credit Real Money to his/her Betting Account or shall have betting bonus received through promotions to be able to place bets or play games in Real Money. Wagers made and bets placed in games while using the Service may only be taken into account if the User’s Betting Account is credited with at least the bet amount in Real Money.

Free Bets, Promotion Bonuses

Promotion or free betting and game bonuses provided by the Company to User from time to time may only be used for placing bets and they may not be transferred, paid out or changed into Real Money.
The Company reserves the right to cancel promotion or free betting or game bonuses provided to User if User fails to use them in their entirety for placing bets in accordance with the regulations of the Company regarding bonuses.
User acknowledges that the above bonuses remain the property of the Company until User uses them for wagers or bets at the occasions required by the Company and thus winnings arising from the bonuses may not be paid out to User until these conditions are met.
The Company has the right to shorten the deadline of promotions.

The free betting and game bonuses and other promotion bonuses of the Company may only be used and exchanged on the Websites where they were issued and they may not be used for other products of the Company.

The free betting and game bonuses or other promotion bonuses that depend on the fulfillment of certain conditions (e.g. the recruitment of further Users) and may only be credited to the Betting Account if such conditions are fulfilled shall not be credited if in the meantime User requested self-freeze or the Company excluded User from the Service.

Payment Methods

Deposits to the Betting Account may be made by bank transfer (through Netxfer Management S. A.), VISA and MasterCard cards, Western Union, Moneybookers or Pay Pal. The required minimum amounts for these payment methods are as follows:

VISA and MasterCard: USD 20
Moneybookers: USD 20
Click2Pay: USD 20

The Company shall not charge deposit and withdrawal transaction fees in any of the above payment methods if User uses the entire deposited amount to place a bet at least once. In any other case, i.e. if the amount deposited or a part thereof is repaid without placing a bet, the bank charges incurred shall be deducted from the amount payable to User.

Payout

User is obliged to make at least one successful deposit using any of the above methods in the amount of the corresponding required minimum and use such amount to place a bet at least once in order be eligible for withdrawal. Furthermore, beyond complying with the above mentioned condition, User is also obliged to make at least one deposit with Moneybookers in order to be eligible for withdrawal from Moneybookers.

User acknowledges that the Company is not required to fulfill any withdrawal request less than USD 50.

The Company guarantees that in co-operation with NetXfer Management S.A. it will initiate the bank transfer of the payouts within 48 hours of the User's withdrawal request.
User acknowledges that any legal relationship or other agreement between Users may only be binding for the Users and the Company shall not be bound thereby in any manner. The Company credits winnings or payouts exclusively to User's own Betting Account or own bank account.
User undertakes to provide full and accurate details of his/her bank account to the Company. User acknowledges that the Company will use such details exclusively for transferring Real Money amounts in legal tender to User's bank account. User also acknowledges that he/she shall be solely responsible for the incorrect or late provision of these bank details.
The Company reserves the right to modify payout transactions in justified cases.

Account Balance

User is free to dispose of the positive balance of the Betting Account from which the bets placed have already been deducted. Winnings shall be credited to the User’s Betting Account where they can be used for further wagers or bets or be transferred to the User’s own bank account.

User agrees that he/she shall immediately notify the Company if Real Money is mistakenly credited to his/her Betting Account or there is a mistaken transfer to his/her own bank account in legal tender. Bets won by amounts credited mistakenly shall be invalid and User shall promptly reimburse Company for monies mistakenly credited to and then transferred from the User’s Betting Account or monies mistakenly credited to the Betting Account and then lost in bets or games.

If the Company notices that User uses the monies on the Betting Account for purposes other than betting and games the Company shall have the right to transfer the balance, after deducting banking and other charges, to the User’s own bank account in legal tender.

Primarily to prevent misuse of credit cards the Company is entitled to check the deposits placed by User and may request a photocopy of the credit card.

If funds are deposited to the User’s Betting Account after the freeze of User’s Betting Account the Company shall notify User and return the amount to the bank account of User where it came from.

Account Statement

The Company shall provide access to the electronic account statement recording the bets and wagers, the winnings, the deposits and withdrawals.

The Company shall provide access to the account statement with respect to at least the preceding 6 months.

Account Complaints

User may challenge the account statements and the balance recorded therein in writing within a 14-day limitation deadline reckoned from the appearance of the statement on the Company’s Website or in the software used for the Service by sending an e-mail to support@mypokersite.com or mail to 95 Wilton Road, Suite 3, London, SW1V 1BZ, United Kingdom or fax to +44 (845) 020 4259. If the written complaint is not received by the Company by the above deadline the account statement and the balance shall be deemed to have been accepted by User.

Rights and Obligations of the Company

In the event of a software error which subsequently rewards a pot to the wrong User, the Company has the right to adjust the balance on the Betting Account of Users participating in the game to correct any and all errors. In such cases the Company will contact all affected Users and present a hand history and detailed explanation of the error within 48 hours.
Users may not act as a team. If team play (collusion) is suspected, the Company has the right to conduct an investigation and suspend the Betting Accounts and claims of the Users concerned while the investigation is being conducted. For the time of the investigation the Users concerned will lose their right of disposal over their Betting Accounts at all poker and casino sites operated by the Company. If collusion is proved the Company has the right to confiscate all winnings gained by the Users by means of collusion. Confiscated winnings will be distributed by the Company among the Users who suffered damages as a result of the collusion to cover their damage.
The Company may revoke the User’s right to play at any time without reasons. In such cases the Company shall pay out the claims on the User’s Betting Account except if it is proved that the User deceived other Users. In this case the Company will distribute the claims on the User’s Betting Account among the Users who suffered damages as a result of the deception or fraud to cover their damage. The Company may not confiscate or withhold the User’s funds for its own use.
The Company’s interpretation, clarification or intervention in connection with any disputes is final and binding on all Users.
If the Company suspects cheating or fraud the Users accused will be investigated and the Company will freeze the affected User’s Betting Account throughout the casino and poker sites operated by the Company. Furthermore, the Company will confiscate the winnings obtained through fraud and will distribute these funds among the Users who suffered damages as a result of the fraud to cover their damage. The Company will inform the Users whose winnings were confiscated of the nick-name of the Users to whom the funds were transferred. The Company may not confiscate or withhold the User’s funds for its own use.
The Company will conduct an investigation against Users that are suspected to be involved in team play (collusion) in order to gain advantage, in particular if they signal card values to each other or make raises and re-raises that are intended to force a victim User out of a pot. During the process the Company will investigate the suspected User’s Betting Account and gaming conduct. If the above abuse committed by the User is proved the Company will suspend indefinitely the Betting Accounts of the Users concerned on all casino and poker sites operated by the Company. All winnings gained by the Users by means of collusion will be confiscates by the Company. Confiscated winnings will be distributed by the Company among the Users who suffered damages as a result of the collusion to cover their damage. The Company may not confiscate or withhold the User’s funds for its own use.
The Company has the right to expel any User from the games organized by the Company if the User violates the provisions of the General Terms or the Poker Terms.
The Company will collect a “rake” as remuneration for organizing and managing the games. Please see the “Poker rake” link for the method of determining and the amount of the “rake”.
The Company has the right to suspend or close the organization of Poker games at any time and the Users are not entitled to claim any damages or compensation in connection with such suspension or closure.

Rights and Obligations of the User

All Users have the right to request a hand history in the event of a dispute.
The game is played for "table stakes" and as such, no User may be forced out of hand for lack of money. To complete the hand, Users will be allowed to go All-In.
Users are allowed to check and raise.
To determine which User’s hand will and must be shown first during the showdown will depend on which User initiated the action or which User initiated the last bet, raise or re-raise.
Users who win a non-called pot are not obligated to show their cards.
Users may not fold a checked hand.
The winning User is determined according to universal poker hand rankings. A summary of these rankings can be found at the “Poker Hand Rankings” link.
If two or more Users tie by holding equally-strong winning five-card hands, the pot will be split between the tying Users. If there is an odd chip, that chip will be broken down to the smallest value chips in the game. If the amount to be split is still uneven, the User who was in earliest position gets the odd chip in flop games. In high-low games, the high hand gets the odd chip.
The “Reserve-Seat” and “Sit-Out” features are intended to allow Users to take a break from the action without losing their seat at the table. Users must return to the game within 10 rounds. If a User fails to return to the game, then he/she will be picked up from the table.
Users are not allowed to buy in with amounts smaller than determined by the Company. The only exception to this rule is if the User has already bought into the game for the acceptable minimum, and wants to add chips from his/her Betting Account, but the value of such buy-ins does not reach the required minimum. In such cases the User will be allowed to add as many chips as he/she has left in his/her Betting Account.
Buy-in on credit is not allowed.
If User notices any error during a game he/she shall immediately notify the Company.

Connection

In the event of a server crash that removes all Users from the table or prevents the hand from continuing, the hand will be considered dead (void) and all monies will be returned to all Users.
If connection is disrupted on the User’s side – whether it occurred because the time limit was exceeded or because there was a disruption in the Internet connection or for any other reason – all stakes paid in by the User will be lost and the Company is not liable for any losses arising from such events.
If the User’s Internet connection breaks down in a “Ring Game” the User will be given extra time. If the User fails to reconnect and resume play the User’s cards will stay in the hand as long as another User raises the pot.

If the system detects that the User is not acting in time while connected to the Internet the system will continue to play in automatic mode instead of the User with the User’s cards (it will check or fold the User’s hand).
If the User’s Internet connection breaks down during a tournament the User shall make all efforts to restore the connection as soon as possible. In such cases the User will keep his/her seat at the table and the system will continue to play in automatic mode instead of the User with the User’s cards.

Governing Law, Place of Performance, Competent Court

The legal relationship between the Company and User shall be governed by the laws of Costa Rica irrespective of the requirements of international private law. The place of performing the obligations arising from bets and games is Costa Rica and in case of legal disputes arising there from the courts of Costa Rica shall have exclusive jurisdiction and competence.

Intellectual Property

User acknowledges that these Terms constitute the intellectual property of the Company, which, similarly to the bets and games specified in the Introduction hereof are protected by law.
The Terms My Poker Site, www.mypokersite.com are the trademarks, Service marks and/or trade names of the Company. Further, all material on www.mypokersite.com, including but not limited to images, pictures, graphics, photographs, animations, videos, music, audio, text, and the games, belong to the Company or an affiliated entity and is protected by copyright law. By using www.mypokersite.com and the materials contained therein and/or herein, you obtain no right to use any of the above-mentioned, without the express written authorization of the Company.

Amendment and Interpretation of the Terms

The Company is entitled to amend these Terms at any time. From the time of the amendment the amended Terms shall be effective and enforceable and User shall make sure that he/she is aware of these amendments.
In case of any discrepancy between the Terms and the Privacy Policy, constituting an inseparable part and exhibit thereof and accessible on the Website, or other rules and regulations placed on the Website, the provisions of the Terms shall prevail. In case any discrepancy or interpretation dispute arises between the English version of the Terms and the related documents and any translated versions thereof the English language version shall prevail.

Licensed Operations

All Services provided by the Company are located at www.mypokersite.com replacement or associated URLs. The Company’s operations are licensed and regulated by the Government of Costa Rica.
All transactions at www.mypokersite.com take place in the territory of Costa Rica. All bets placed on www.mypokersite.com are placed on servers located in Costa Rica.
In the event that You have any complaints, claims or disputes with regard to any outcome regarding the Services or any other activity performed by the Company, you should in the first instance contact the Company in accordance with Section ACCOUNT COMPLAINTS above. If you are not satisfied with the Company’s response you may contact the Ministry of Economics and Trade of Costa Rica via e-mail informacion@meic.go.cr.

Anti Money Laundering

The site will be monitored for money laundering activity. All our employees have been fully trained and we have mechanisms to identify possible suspicious transactions. It is unlawful to deposit funds obtained from ill-gotten means and all transactions will be monitored and checked. Any suspicious activity will be reported to the Operations Manager who in turn will inform the directors if the transaction is confirmed to be highly risky. The player will not be forewarned and he may be investigated while still being allowed to play on the site. If deemed necessary, the matter will be reported to the relevant authorities.
